Haitian nationals that have come to the United States on or before November 6th, 2022 with no permanent status are now eligible to apply for Temporary Protective Status (TPS). This must be done before the date of August 3rd, 2024.
In addition, in order for Haitian nationals who already have TPS to extend their status and work authorization, they must re-register before the date of March 27th, 2023.
What is Temporary Protective Status (TPS)?
According to the U.S. Citizenship and Immigration Services website, the Secretary of Homeland Security may designate TPS to a foreign country due to conditions there that temporarily prevent the country’s nationals from returning safely – or in certain circumstances – where the country is unable to handle the return of its nationals adequately.
During their designated period, individuals who have TPS:
- Are not removable from the United States
- Can obtain an employment authorization document (EAD)
- May be granted travel authorization
Once granted TPS, an individual also cannot be detained on the basis of their immigration status.
What Documents Do I Need to Apply for Haitian TPS?
If you are preparing to apply before the deadline, there are documents you can get in order to ensure a smooth and accurate process. You should have:
- Proof of Haitian nationality: Passport or birth certificate with photo identification.
- Date of entry into the United States: I-94, passport entry stamp, or other documents with this info.
- Documents to show that you have been in the United States since November 6, 2022.
- Most recent work permit (if applicable).
- A Certificate of Disposition from the court if you have ever been arrested.
