If you are a rideshare driver in New York who happens to be driving out of state for any reason, getting a traffic ticket can lead to serious problems. Ones that can affect your ability to work; especially if they are considered misdemeanors – which in legal terms is called reciprocity.

What is Reciprocity?

Reciprocity is an agreement between two states that allows them to share information about traffic violations. This means that if you are ticketed for a traffic violation in one state, the other state may be able to see that violation on your driving record.

In most cases, reciprocity agreements only apply to traffic violations that are considered crimes in both states.

How Are Rideshare Drivers Affected?

Most think pleading guilty and paying the fine for an out of state ticket is the easiest way to handle the situation. THAT IS FALSE. Pleading guilty can potentially result in:

  • Deactivation. If a driver receives an out-of-state ticket for a misdemeanor traffic violation, they could be deactivated from driving for rideshare companies, because many rideshare apps have policies that prohibit drivers who have been convicted of misdemeanor traffic violations from working for them.
  • Insurance Rates. If a driver is convicted of a misdemeanor traffic violation in another state, it could also affect their insurance rates, because insurance companies use driving records to assess risk, and a conviction for a misdemeanor traffic violation could be seen as a sign of increased risk.
  • Suspended License. If a driver is convicted of a misdemeanor traffic violation in another state, it could also lead to the suspension of their driver’s license in New York. This is because New York will honor the convictions of other states per their established agreements.
