Key Takeaways

NYC rideshare drivers must follow both NYPD traffic laws and TLC rules, each with separate points and penalties. A single violation can add points to both licenses, putting your ability to drive at risk. IDG Legal helps drivers dispute violations and safeguard their licenses and income.

Driving for Uber or Lyft in New York City means you’re subject to a dual system of regulations enforced by both the New York Police Department (NYPD) and the Taxi & Limousine Commission (TLC). Understanding the difference between an NYPD violation and a TLC summons is crucial for protecting your livelihood.

Here’s a breakdown to help you keep things straight:

NYPD Violations

    • What it is: A ticket for a general traffic infraction.
    • Who issues it? The New York Police Department.
    • Who does it apply to? All drivers, whether you’re on the clock or not.
    • Examples: Speeding, running a red light, failing to yield, using a cell phone while driving.
    • Key Impact: Points on your DMV license.
        • Accumulating 6 or more points within 18 months triggers a Driver Responsibility Assessment (DRA) fee from the DMV. This is a separate fee paid in addition to any fines.
        • Accumulating 11 or more points within 18 months can lead to a suspended state driver’s license. Without a valid DMV license, you cannot drive for any rideshare company.

    • How to dispute it: You go to the Traffic Violations Bureau (TVB).
        • There is no plea bargaining at the TVB. Your only options are to plead guilty or fight the ticket entirely (which is recommended for rideshare drivers).

TLC Summonses

What it is: A summons for violating specific rules for for-hire vehicles.

  • Who issues it? A TLC enforcement agent.
  • Who does it apply to? Only drivers operating a TLC-licensed vehicle.
  • Examples: Consumer complaints, expired documents, improper in-vehicle display, and more.
  • Key Impact: Points on your TLC license.
    • The TLC has its own separate point system. These points are in addition to any you may have on your DMV license.
    • Accumulating 6 to 9 points on your TLC license within a 15-month period can lead to a suspension.
    • Accumulating 10 or more points within 15 months can lead to a revocation of your TLC license. A revocation can be a serious setback, requiring you to wait a set period before you can re-apply.
  • How to dispute it: You go to the Office of Administrative Trials and Hearings (OATH).
    • Unlike the TVB, you may be able to negotiate a settlement with a TLC prosecutor to get a reduced fine.
    • At the hearing, the TLC must present evidence to prove its case.
    • Hire IDG Legal’s TLC specialist to guide you through the process.

The “Double Jeopardy” Effect: When Both Systems Intersect

This is a critical point that many drivers miss: A single violation can trigger consequences from both the NYPD/DMV and the TLC.

For instance, if you get a speeding ticket from an NYPD officer while driving a TLC vehicle, you may be facing a “double whammy.” The conviction for the speeding ticket will add points to your DMV license. The TLC, however, can also assess points on your TLC license based on that same conviction.

The TLC’s “Persistent Violator Program” combines DMV points and TLC points. This means a driver’s TLC license can be suspended or revoked if they accumulate a certain number of points from both sources combined within a 15-month period.
