1. The Right to Remain Silent

If you are stopped or questioned by immigration officers or police, you have the right to remain silent. You do not have to answer questions about your immigration status or where you were born. You can simply say, “I choose to remain silent.”

It’s a good idea to carry a “Know Your Rights” card that states your right to remain silent and your right to speak to a lawyer. You can hand this card to officers if you feel uncomfortable speaking.

2. The Right to a Lawyer

If you are detained by Immigration and Customs Enforcement (ICE), you have the right to speak to a lawyer. However, unlike in criminal cases, the government will not provide one for you. This is why having access to legal assistance beforehand is vital.

5. The Right to Education and Healthcare

All children, regardless of their immigration status, have the right to attend public school in the U.S. Additionally, certain healthcare services are available to everyone, including emergency care. If you or your family members are in need of medical help, do not hesitate to seek care.

6. The Right to Work Safely

Immigrant workers have the right to safe working conditions and to be paid fairly for their labor. If your employer threatens to report you to immigration for standing up for your rights, that’s illegal.
