New York State just revamped its traffic laws, and it’s a big deal for everyone, especially rideshare drivers. These changes affect:  

  • How many points you get on your license for violations
  • The penalties
  • How to get your license back if it’s suspended 

The rules are tougher now, so being informed is crucial.

Here’s what’s changed:

  • Longer ‘Look-Back’ Period: When the New York State Department of Motor Vehicles (DMV) reviews your driving record, they’re now looking at the past two years (24 months), not just 18 months. This means even old tickets could hurt you now. Important: It’s not clear if this applies to all old tickets or just the ones you get after the new rules. This could be a problem for some drivers.
  • Speeding in Construction Zones: Getting caught speeding in a construction zone now automatically gets you 8 points on your license, no matter how fast you are going. Before, it depended on how far over the limit you were. This is one of the biggest penalties you can get.
  • DUI and Related Offenses: Driving under the influence of alcohol or drugs (DWI, DWAI, etc.) now gets you 11 points. While these points might not count immediately for a first-time DUI suspension, you’ll still face other penalties, and repeat offenses will really stack up against you. Also, expect a big fine for a DUI.
  • New Point Values for Other Violations: Some things that didn’t used to get you points now do, and other violations have had their point values increased. Here are a few examples:
    • Driving with a Suspended License: 11 points (NEW)
    • Helping Someone Drive with a Suspended License: 5 points (NEW)
    • Racing: 5 points (NEW)
    • Passing a Stopped School Bus: 8 points (Used to be 5)
    • Careless Driving: 5 points (Used to be 2)
    • Leaving the Scene of an Accident with Injuries: 5 points (Used to be 3)
  • More Points = More Problems: If you rack up too many points, expect warning letters, mandatory driver improvement courses, and even suspension hearings. You’ll have to go to a hearing if:
    • You get 11 or more points in two years
    • 9 or more points from speeding in two years
    • 4 or more points within a year of a previous hearing

Even if you don’t hit the point limit, you could still face a hearing if you get a bunch of tickets in a short period.

  • DMV System is Behind: Even though the new rules are in effect, the DMV’s computer system isn’t updated yet. It’s not clear how they’ll be tracking points in the meantime, so stay extra careful.

What this means for Rideshare Drivers:

As a rideshare driver, you’re on the road a lot, which means more chances to get tickets. These changes make it easier to lose your license, which would put your livelihood at risk. Be extra careful, especially in construction zones, and avoid any alcohol or drug use before driving.
